Privacy Notice

This Privacy Notice explains what Seat Side collects, why we use it, when we disclose it, how long we retain it, and the choices available to you.
1. Scope
This Privacy Notice applies to the Seat Side website, web application, mobile experience, ordering tools, transactional communications, customer support, and in-venue merchandise delivery services (collectively, the "Service"). "Seat Side," "we," "us," and "our" refer to Seat Side and its authorized operators.
This Notice does not govern the independent privacy practices of venues, artists, tours, promoters, teams, merchandise sellers, payment processors, ticketing companies, or other third parties. Their notices may also apply when they separately collect or control your information.
2. Privacy at a Glance
- What we need: Contact information, event and seat details, order information, delivery communications, and technical data needed to operate the Service.
- Why we use it: To accept payment, fulfill and verify orders, communicate with you, prevent fraud, support customers, comply with law, and improve operations.
- Who receives it: Service providers and, when necessary for fulfillment, the applicable venue, merchandise seller, promoter, team, or event partner.
- Analytics: We provide partners with aggregated or de-identified sales and delivery insights whenever practical.
- No data sale or targeted advertising: Seat Side does not currently sell personal information for money or share it for cross-context behavioral advertising.
- Your choices: Depending on your location, you may request access, correction, deletion, or portability and may exercise other applicable privacy rights.
3. Information We Collect
A. Information You Provide
- Account and contact information: Name, email address, mobile number, login credentials, and communication preferences.
- Event and delivery information: Venue, event, section, row, seat, aisle, suite, club, accessibility location, entry point, delivery notes, seat changes, and other routing details.
- Order information: Items selected, size, color, quantity, merchandise seller, price, fees, taxes, tip, discounts, order status, pickup or delivery selection, and transaction identifiers.
- Payment-related information: Billing details and payment status. Full payment-card numbers are generally collected and processed by our payment processor rather than stored by Seat Side. We may receive a token, card type, last four digits, expiration information, authorization result, and fraud signals.
- Communications and support: Messages, call or chat details, complaints, refund requests, survey responses, and other information you submit to support.
- Optional information: Information you choose to provide in delivery notes. Please do not include medical diagnoses, government identifiers, payment-card numbers, or other unnecessary sensitive information.
B. Information Collected During Delivery
- Fulfillment records: Runner assignment, preparation and handoff timestamps, status updates, attempted-delivery information, pickup records, and issue reports.
- Delivery verification: An order code, signature or acknowledgment, runner confirmation, photograph of the handoff or delivery location, and related metadata when permitted by venue rules and disclosed in the Service.
- Communications: Transactional text, call, push-notification, or in-app message records used to locate you or resolve a delivery issue.
Seat Side does not use delivery photographs for facial recognition or biometric identification. Delivery photographs should focus on the order and delivery location and avoid capturing bystanders whenever reasonably possible.
C. Information Collected Automatically
- Device and network data: IP address, browser type, device type, operating system, language, mobile carrier, identifiers, and approximate location derived from IP address.
- Usage information: Pages or screens viewed, buttons selected, order-flow events, timestamps, referring pages, session information, crash reports, and performance logs.
- Cookies and similar technologies: Technologies used for authentication, security, cart functionality, preferences, analytics, and service performance.
Seat Side does not collect precise GPS location unless a feature explicitly requests it and you choose to grant device permission. Seat and venue information you enter is used as the primary delivery location.
D. Information From Other Sources
We may receive information from payment processors, venues, merchandise sellers, promoters, teams, staffing and delivery providers, communications providers, fraud-prevention services, ticketing or event systems when integrated, and public or commercial sources used for security and compliance. We may combine this information with information collected through the Service.
4. How We Use Information
Seat Side uses personal information to:
- create and secure accounts;
- display available merchandise and service options;
- process payments, authorize transactions, calculate fees and taxes, and provide receipts;
- prepare, route, deliver, verify, and troubleshoot orders;
- contact you about order status, seat verification, delivery attempts, pickup, refunds, safety, and support;
- confirm inventory and coordinate with venues, merchandise sellers, promoters, teams, runners, and event personnel;
- prevent fraud, abuse, chargebacks, unauthorized access, and security incidents;
- maintain records, resolve disputes, enforce our Terms, and comply with legal obligations;
- measure adoption, delivery performance, product demand, average order value, peak ordering periods, and service quality;
- improve, test, maintain, and develop the Service; and
- send marketing communications only when permitted and subject to the choices provided.
5. Data Analytics for Venues and Merchandise Partners
Seat Side is designed to help venues and merchandise partners understand and optimize fan-facing merchandise sales. We may provide event partners with reports covering order volume, product popularity, average order value, order timing, delivery time, fulfillment accuracy, service adoption, and operational demand.
We use aggregated or de-identified information for these reports whenever practical. We may disclose identifiable order or delivery information when reasonably necessary to fulfill an order, investigate a problem, process a return or refund, prevent fraud, comply with law, or meet an event partner's legitimate operational responsibility.
Seat Side does not represent aggregated or de-identified information as personally identifiable and does not attempt to reidentify information that has been de-identified, except to test whether de-identification measures are effective.
6. How We Disclose Information
We may disclose personal information to:
- Service providers: Hosting, cloud storage, payment processing, communications, analytics, customer support, cybersecurity, fraud prevention, accounting, legal, and other vendors that perform services for us.
- Venues and event partners: The applicable venue, merchandise seller, artist or tour representative, promoter, team, concessionaire, staffing provider, and delivery personnel when needed to fulfill, verify, support, or reconcile an order.
- Payment and financial partners: Payment processors, card networks, banks, fraud services, and tax or accounting providers.
- Legal and safety recipients: Courts, regulators, law enforcement, venue security, emergency personnel, or others when we reasonably believe disclosure is necessary to comply with law, protect safety, investigate misconduct, or defend rights.
- Business transaction recipients: Potential or actual investors, lenders, buyers, sellers, professional advisers, or successors in connection with financing, diligence, merger, acquisition, reorganization, bankruptcy, or sale of assets, subject to appropriate safeguards.
- At your direction: Other persons or services when you request or consent to the disclosure.
7. Sale, Sharing, and Targeted Advertising
Seat Side does not currently sell personal information for money, share personal information for cross-context behavioral advertising, or use personal information to target advertisements based on activity across unrelated businesses.
We may disclose information to service providers and event partners for the operational purposes described in this Notice. If our practices change in a way that creates a right to opt out, we will update this Notice and provide the legally required choice before the change applies.
8. Cookies and Analytics Choices
Seat Side may use necessary cookies for authentication, security, cart and checkout functionality, preferences, and fraud prevention. We may also use limited analytics technologies to understand performance and improve the Service.
You may control cookies through browser or device settings. Blocking necessary technologies may prevent ordering, login, or delivery features from functioning. Where required, we will provide a consent or preference tool for nonessential technologies.
9. Communications Choices
Transactional messages about an order, payment, delivery, pickup, event, safety issue, or support request are part of the Service. Message and data rates may apply. You may disable push notifications through device settings, but doing so may interfere with delivery.
You may unsubscribe from promotional email using the link in the message and opt out of promotional texts using the instructions provided. Opting out of marketing does not stop necessary transactional communications.
10. Retention
We retain personal information only as long as reasonably necessary for the purposes described in this Notice, including fulfillment, support, accounting, fraud prevention, security, dispute resolution, contractual obligations, and legal compliance.
Our intended baseline retention periods are:
- Account information: While the account remains active and for a reasonable period afterward.
- Transaction and accounting records: Generally up to seven years, subject to tax, accounting, payment, and legal requirements.
- Delivery photographs and routine verification records: Generally up to 90 days, unless needed longer for a dispute, chargeback, safety issue, fraud review, partner reconciliation, or legal obligation.
- Customer-support and dispute records: Generally up to three years after the matter closes, or longer when reasonably necessary for an active claim.
- Technical and analytics logs: Generally up to 12 months unless security, fraud, or legal needs require longer retention.
We may retain aggregated or de-identified information for longer. Actual periods may vary when law, litigation holds, venue or seller reconciliation, fraud prevention, or technical backup cycles require a different period.
11. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including access controls, vendor management, secure transmission where appropriate, monitoring, and incident-response procedures. No system, transmission, or storage method is completely secure, and we cannot guarantee absolute security.
Protect your account credentials, use a secure device, and notify Seat Side promptly if you suspect unauthorized account or payment activity.
12. Your Privacy Rights
Depending on where you live and subject to legal exceptions, you may have the right to request access to, correction of, deletion of, or a portable copy of personal information; to learn about categories of information collected and disclosed; to opt out of certain sales, sharing, targeted advertising, or profiling; to limit certain uses of sensitive information; and to appeal a denied request.
Seat Side does not discriminate against you for exercising an applicable privacy right. To submit a request, use the privacy or support contact displayed in the Service and state the right you wish to exercise. We may verify your identity by matching information associated with your account or order and may request additional information when reasonably necessary. An authorized agent may submit a request where permitted by law, subject to verification of authority and identity.
We will respond within the period required by applicable law. Some information may be retained or withheld when necessary to complete a transaction, detect fraud, protect security, comply with law, exercise legal rights, or meet another lawful exception.
13. Children's Privacy
The Service is not directed to children under 13, and Seat Side does not knowingly collect personal information online from a child under 13 without legally required parental consent. If we learn that we collected such information without appropriate authorization, we will take reasonable steps to delete it. A parent or guardian who believes a child provided information should contact us through the method displayed in the Service.
Users under 18 may use the Service only with the involvement and consent of a parent or legal guardian, as described in the Terms of Service.
14. Accessibility and Sensitive Delivery Notes
Seat Side may collect an accessibility location or routing instruction when needed to complete delivery, but we do not need your diagnosis or medical history. Provide only the minimum information required to identify the correct delivery route or location.
15. External Services
The Service may contain links to or integrations with third-party services. Seat Side is not responsible for their privacy practices. Review the privacy notices of payment processors, venues, merchandise sellers, ticketing services, and other third parties you use.
16. Processing Location
Seat Side is operated from the United States. Personal information may be processed in the United States and other locations where service providers operate. Those locations may have different data-protection laws than your home jurisdiction.
17. Changes to This Notice
We may update this Privacy Notice to reflect changes in the Service, technology, partners, or law. The revised Notice will state a new effective date and will be posted or presented through the Service. We will provide additional notice or obtain consent when required for a material change.
18. Contact Us
For privacy questions or requests, use the privacy or support contact displayed in the Service. Include your name, the email address or mobile number associated with your account, the relevant order number if applicable, your state of residence, and the privacy request you are making. Do not send payment-card information, government identifiers, or unnecessary sensitive information through ordinary email.
